We have recently noticed a growing number of cases where in house Data Protection Compliance Managers have got into deep water over Data queries but have not asked for help when the situation was beyond their experience and ability.
Sometimes the Manager thought they were acting correctly, sometimes they did not want to admit they were overwhelmed but in each case the potential consequences for the business were very serious. NB: The average small business fine from the Data Regulator is currently over £40,000.
The majority of these incidents related to three areas in particular: Data Subject Access Requests, assessing potential Data Breaches and giving advice relating to the lawfulness of proposed Marketing activity. Unsurprisingly, these are also the three areas in which most small businesses experience problems with the Regulator and can end up being fined.
